This document comprises the Terms of Use Agreement, (hereinafter referred to as the “Agreement”), and constitutes a legally binding agreement between the visitor/user of FindUniversity.ph (hereinafter, “FUP”).

As a condition precedent to the visitor/user being able to use any of the tools, functions, and information on this site, the visitor/user must read, understand and agree to be bound by each of the terms and conditions contained in this Agreement. However, by the mere act of accessing the functions and tools of this site, viewing any information, text or graphics herein, the visitor/user is deemed to have already read, understood, and agreed to be bound by this Agreement. Should the visitor/user not agree to any of the terms and conditions of this Agreement, he/she must immediately leave this site and desist from using any of the tools, functions, and information provided herein.

FUP reserves the right to amend or modify this Agreement without prior notice to the visitor/users. Thus, every time the visitor/user accesses this site, he/she is responsible for viewing this Agreement for any updates, amendments, changes, and revisions to which the visitor/user shall be deemed to be automatically bound.

The visitor/user agrees to use the information, services, and tools available on the site for purely personal and non-commercial use.

Purpose of this Site and Limitation on Liability

This site only provides general information and data on certain colleges and universities in the Philippines, including but not limited to information on the degrees, courses and programs offered by such educational institutions, their admission requirements, school contact information, location, curriculum, and the like, obtained through a process of simple research of information and data that are already available on the internet without verification as to the truth or accuracy of any of the general information obtained from such research. In some cases, FUP may have received compensation from educational institutions who wish their establishments to be mentioned on this site, in which case, the relevant information and data have been entirely provided by such educational institutions.

FUP strives to provide its visitors/users with information and data regarding certain Philippine colleges and universities which are current. However, FUP is not responsible for any information that is found to be inaccurate, incomplete, incorrect or misleading.

FUP does not warrant the accuracy of the general information and data found on this site, and further, it does not warrant the existence, qualifications or competence of any of the Philippine colleges, universities and educational institutions mentioned in this site.

The visitor/user is responsible for conducting his/her own due diligence investigations into the existence, quality of education, or competence of any of the educational institutions mentioned in this site and for validating any information, data or statistics regarding the Philippine educational system. The visitor/user shall hold FUP free and harmless and shall indemnify FUP for any claim or liability, whether the cause of action is based on tort, breach of contract, or any other legal theory, including punitive, actual, direct, incidental or consequential damages of any nature, arising from the visitor/user's independent due diligence investigations and validations of the information contained herein; or for any damage, loss or injury that may have been incurred by the visitor/user or any other person who may have received information from such visitor/user regarding any information, data or statistic published on this site or arising from any enrolment or transactions with any of the educational institutions mentioned herein.

Rules for Use of Site

Site visitors/users may not:

1. Violate the laws of any jurisdiction, state, or country while visiting our site or using any tool that is available on this site;
2. Harass or cyber stalk any user;
3. Post any information, entries, queries, guest book notes, etc., which, in the sole and absolute discretion and opinion of FUP, may be considered as obscene, indecent, defamatory, offensive, or hateful;
4. Upload a virus on the server, whether or not such virus causes damage to FUP or FUP's visitors/users;
5. Transmit, steal, or otherwise engage in unauthorized access of information, data or materials through or into this website, which may be in violation of any law or regulation in any jurisdiction.
6. Use any automated script or robots to access, copy, or manipulate any content provided in this site.
7. Impersonate any person or entity or misrepresent your affiliation with any other person or entity.
8. Insert your own or a third party's advertising material or promotional content on this site.
9. Use the site in any manner with the intent to interrupt, damage, or disable, overburden, impair the site, including but not limited to, flooding servers with requests;
10. Attempt to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the site or any content thereof.

All visitors/users of this site must be of legal age in their jurisdiction or country of origin. All visitors/users who are not of legal age must immediately leave the website and desist from using any of the tools, functions, information provided in this site unless such visitor/user is supervised by his/her parents or legal guardian, in which event, the parent or legal guardian shall be responsible for filtering any inappropriate content on this site.

FUP may post rules, guidelines or policies in addition to those stated in this Agreement. Upon the posting of such new or additional materials, such terms and conditions will immediately form part of this Agreement and shall be deemed as automatically binding on the visitors/users.

Disclaimer

FUP does not have any direct knowledge of or affiliation with most of the Philippine colleges and universities mentioned in this site. Even in cases where FUP may have received compensation from any educational institution who wish their colleges or universities to be mentioned on this site, FUP has made no further study regarding the accuracy and truthfulness of the matters represented and advertised by such establishments on this site. Thus, FUP has no knowledge or responsibility regarding the existence, qualifications, quality of service, or competence of any the Philippine colleges and universities mentioned in this site nor does it have any information on the competence and qualifications on the administrators, teachers and professors in such educational institutions.

Links to third party websites are intended as tools only and, in the event that the visitor/user is directed by way of third party link to the website of any educational establishment mentioned on this site, FUP also bears no responsibility for the content and information found on such websites.

Any and all information published on the website regarding certain Philippine colleges and universities have been gathered and presented by FUP on its own initiative using the websites and information from such establishments, which are already made available to the public or have been provided by the said educational institutions to FUP for posting on this site. FUP does not verify the accuracy of the information gathered from such websites and cannot vouch for their reliability and accuracy, nor can FUP warrant that such information is current and updated.

While FUP has no reason to believe that there are inaccuracies or defects in any of the information published on the website, it makes no representations or warranties, express or implied, including but not limited to the fitness of the information for any purpose whatsoever. The site is provided on an “as is” or “as available basis” and the visitor/user uses the same entirely at his/her own risk. In providing the information to visitor/user, no contractual obligation is or has been constituted between the visitor/user and FUP and no duty of care is owed to the former. If any court of competent jurisdiction rules that FUP owes a duty of care to the visitor/user, FUP will not be liable for any direct or indirect consequences, loss, damages or injury arising from use of this information, unless there is a direct negligence or fault on the part of FUP, which is proven in a court of competent jurisdiction.

This site is intended as a database only, which may enable its visitors/users to conduct their due diligence investigations and research into the Philippine colleges and universities mentioned herein. The visitor/user should not solicit or rely upon any representations or recommendations from any officers of FUP.

Miscellaneous

This Agreement and that relationship between the visitor/user and FUP shall be governed by the laws of the Philippines, without regard to conflict of law provisions. The visitor/user agrees that any cause of action that may arise under this Agreement shall be commenced and heard exclusively in the appropriate courts of Makati, Philippines. Failure by FUP to exercise or enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be unenforceable or invalid, the visitor/user agrees to cooperate with FUP for the reasonable application of such provision in order to give full force and effect to the intent of this Agreement.
